THE JAYL HOUSE
(operating under JENESIS MEDICAL AESTHETICS INC.)
Contrast Therapy & Recovery Wellness House — 500 Industrial Park Cresent, Sault Ste. Marie,
Ontario
INFORMED CONSENT, RELEASE OF LIABILITY & WAIVER OF CLAIMS
This Waiver and Release of Liability (the “Waiver”) is entered into by the undersigned individual
(“Member” or “Guest”) in consideration of being permitted to use the facilities, services, and
amenities of The Jayl House, including but not limited to the sauna, cold plunge, performance
plunge, red light therapy room, and recovery room. Please read this document carefully and in its
entirety before signing.
1. Nature of Activities & Inherent Risks
I understand that contrast therapy and recovery modalities involve deliberate exposure to extreme
heat, extreme cold, and light-based therapy, which carry inherent physical risks. These activities
include, but are not limited to:
- Sauna sessions: exposure to high temperatures (typically 70–100°C / 158–212°F) which may cause dizziness, dehydration, heat exhaustion, fainting, or cardiovascular stress.
- Cold plunge & performance plunge sessions: immersion in cold water (standard plunge typically
5–15°C / 41–59°F) which may cause cold shock response, involuntary gasping or hyperventilation,
muscle cramps, numbness, loss of motor control, and sudden changes in heart rate and blood
pressure.
- Red light therapy: exposure to concentrated red and near-infrared light, which may cause eye
strain, headache, mild skin warmth or irritation, or photosensitivity reactions, particularly when
combined with certain medications or medical conditions.
- Recovery room use: periods of rest and temperature regulation between modalities, which may
still carry residual physiological effects such as lightheadedness or delayed drops in blood pressure.
- The cumulative physical demand of alternating between hot and cold environments, which places
stress on the cardiovascular and nervous systems. I acknowledge that these risks exist regardless of the care taken by The Jayl House staff, and that no amount of instruction or supervision can fully
eliminate them.
2. Scope, Duration & Electronic Acceptance I understand and agree that:
- This Waiver applies to my first visit and to every subsequent visit to The Jayl House, and remains in full force and effect for the entire duration of my relationship with The Jayl House, unless and until it is revoked in writing or replaced by an updated version.
- If I access the facilities on multiple occasions, I am bound by this Waiver on each occasion without
the need to sign a new document each time.
- Where this Waiver is presented and accepted electronically (including through The Jayl House’s
online booking system), my electronic acceptance constitutes my legally binding signature and
carries the same force and effect as a handwritten signature, and the date and time of acceptance is
recorded by the system.
- It is my responsibility to review any updated version of this Waiver that I am asked to accept.
3. Age Requirements
Access to all facilities at The Jayl House is subject to the following age requirements:
- Guests must be 18 years of age or older to use any facility without restriction.
- Guests between the ages of 16 and 17 may access standard facilities only when accompanied by a parent or legal guardian who is 18 years of age or older for the duration of their visit.
- Guests under the age of 16 are not permitted to use any facility at The Jayl House.
- The accompanying adult accepts full responsibility for the safety and conduct of any minor in their
care during the visit.
- The Jayl House reserves the right to request valid photo identification to verify age at any time.
4. Health Eligibility & Medical Acknowledgment
I confirm that I am in good physical health and that I am voluntarily choosing to participate in
contrast therapy and recovery activities. I represent that I have disclosed to The Jayl House, or have
independently assessed, any condition that may affect my safe participation. I acknowledge that
these activities may be contraindicated for individuals with certain health conditions, including but
not limited to:
- Cardiovascular conditions, including heart disease, high or low blood pressure, arrhythmia, or a
history of heart attack or stroke.
- Respiratory conditions, including asthma or chronic obstructive pulmonary disease (COPD).
- Epilepsy or seizure disorders.
- Raynaud’s disease or other circulation disorders.
- Pregnancy.
- Open wounds, skin infections, or recent surgical or cosmetic procedures.
- Diabetes or other metabolic conditions.
- Photosensitivity disorders, lupus, porphyria, or a personal history of skin cancer or melanoma
(relevant to red light therapy).
- Use of photosensitizing medications (see Section 7).
- Claustrophobia or anxiety disorders that may be exacerbated by enclosed hot or cold environments.
- Any condition for which a physician has advised against exposure to heat, cold, or light therapy. I
confirm that I have consulted with a qualified healthcare provider if I have any of the above
conditions or any other condition that may be affected by these activities. I take full responsibility
for my decision to participate and acknowledge that The Jayl House staff are not medical
professionals acting in a clinical capacity and cannot assess my fitness to participate on my behalf.
5. Sauna Protocols & Safety Rules
I agree to abide by all sauna safety protocols at The Jayl House, including:
- Showering before entering the sauna.
- Limiting sauna sessions to a maximum of 15–20 minutes at a time unless otherwise directed by
staff.
- Exiting the sauna immediately if I experience dizziness, nausea, shortness of breath, chest pain, or
any unusual symptoms.

- Respecting other guests’ space and maintaining appropriate conduct at all times.
6. Cold Plunge Protocols & Safety Rules
I agree to abide by all cold plunge safety protocols at The Jayl House, including:
- Entering the cold plunge slowly and mindfully, allowing my body to adjust to the temperature.
- Never submerging my head underwater unless explicitly instructed by staff.
- Limiting standard cold plunge immersion to a maximum of 2–5 minutes at a time, or as directed by
staff.
- Exiting the cold plunge immediately if I experience intense chest tightening, inability to

that may impair judgement.
- Not using the cold plunge if I have any open wounds, skin infections, or contagious skin conditions.
- Showering before entering the cold plunge to maintain water hygiene.
7. Red Light Therapy Protocols & Safety Rules
I understand that the red light therapy room uses concentrated red and near-infrared light. It does
not emit UV radiation and is not a tanning device; however, it carries its own precautions. I agree to
abide by all red light therapy safety protocols, including:
- Wearing the eye protection provided and never staring directly into the light source, as
concentrated light may cause eye strain or discomfort.
- Limiting sessions to the duration and distance directed by staff or the device manufacturer, and not
exceeding recommended exposure times.
-Removing makeup, lotions, oils, or sunscreen from the treatment area beforehand, as these may
affect results or cause a reaction, unless otherwise directed by staff.
- Exiting the room and notifying staff if I experience headache, dizziness, eye discomfort, skin
irritation, or any unusual symptom during a session.
I confirm that I have considered, and where applicable consulted a healthcare provider about, the
following before using red light therapy:
- Photosensitizing medications. I understand that certain medications and supplements increase
sensitivity to light — including but not limited to some antibiotics (such as
tetracyclines/doxycycline), isotretinoin, and other retinoids, certain diuretics, lithium and some other
psychiatric medications, and St. John’s Wort — and that I am responsible for confirming whether any
medication I take may cause a photosensitivity reaction.
- Photosensitive conditions. I confirm I do not have lupus, porphyria, or another photosensitivity
disorder, or that I have received medical clearance to proceed.
- Skin cancer history. I confirm that I have disclosed any personal history of skin cancer or
melanoma and will not treat any active, undiagnosed, or suspicious skin lesion.
- Recent cosmetic or skin procedures. If I have recently received injectables, laser treatment,
chemical peels, or other skin procedures, I will follow the waiting period advised by my provider
before red light exposure.
- Pregnancy. If I am pregnant, I will consult my physician before using red light therapy.
8. Recovery Room/Lounge Protocols
I understand that the recovery room is a designated rest space between contrast sessions and agree to:
- Allow adequate time for my body to return to a resting state between hot and cold sessions.
- Hydrate regularly throughout my visit. Water is available and I am responsible for maintaining my
own hydration.
- Notify staff immediately if I feel unwell, faint, or experience any symptoms of concern during my
recovery period.
- Keep noise levels respectful of other guests using the recovery space.
- Not use the recovery room for extended periods that prevent other guests from accessing it.
- Keep the recovery room clean and tidy at all times.
9. General House Rules
- I will treat all staff, guests, and facilities with respect at all times.
- I will not engage in any behaviour that is disruptive, judgemental, unsafe, or harmful to others.
- I understand that The Jayl House reserves the right to refuse service or remove any individual from
the premises, without refund, for failure to follow protocols or for conduct deemed unsafe or
inappropriate.
- I will not photograph or record other guests without their explicit consent.
- I understand that The Jayl House is a wellness space and I will conduct myself accordingly.
10. Photography, Media & The Vault
I understand that The Jayl House may, from time to time, photograph or record the space, events,
and completion milestones, including record and achievement boards displayed on the premises, for
record-keeping and marketing purposes.
- The Jayl House will not photograph or record me as the identifiable subject for marketing or social
media without my consent.
- Where I provide that consent (including by initialling or selecting the media-consent option), I
grant The Jayl House permission to use my image and likeness in promotional materials and on
social media, without compensation, and I may withdraw this consent for future use at any time by
notifying The Jayl House in writing.
- Recording or photographing other guests without their explicit consent is prohibited.
11. Personal Property
I understand that I am responsible for my own personal belongings at all times. The Jayl House is
not responsible or liable for any loss, theft, or damage to personal property brought onto the
premises, including items stored in lockers or left in changing or recovery areas.
12. Release of Liability & Assumption of Risk
In consideration of being permitted to use the facilities and services of The Jayl House, I, on behalf
of myself, my heirs, executors, administrators, and assigns, hereby voluntarily:
- Assume full responsibility for all risks, injuries, losses, or damages arising from my participation in
contrast therapy, red light therapy, and use of The Jayl House facilities.
- Release, waive, discharge, and covenant not to sue The Jayl House, its owners, operators,
employees, agents, volunteers, and representatives from any and all liability, claims, demands,
actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that
may be sustained by me while using the facilities or services.
- Acknowledge that this release is intended to apply to claims arising from the ordinary negligence of
The Jayl House, to the fullest extent permitted by law, but does not apply to gross negligence or
wilful misconduct.
13. Indemnification
I agree to indemnify, defend, and hold harmless The Jayl House, its owners, operators, employees,
agents, volunteers, and representatives from and against any claims, losses, liabilities, damages,
costs, or expenses (including reasonable legal fees) brought by any third party and arising out of or
related to my conduct, my breach of this Waiver, or my use of the facilities and services, to the
fullest extent permitted by law.

I acknowledge that in the event of a medical emergency, The Jayl House staff will:
- Call 911 immediately if there is any risk to life.
- Provide basic first aid until emergency services arrive.
- Make every reasonable effort to ensure my safety and well-being. I consent to emergency medical
treatment being sought on my behalf if I am unable to communicate my wishes. I agree to provide
accurate emergency contact information to The Jayl House upon registration.
15. Membership Terms, Payment & Cancellation
By enrolling in a membership at The Jayl House, I confirm that I have read, understood, and agree to the following terms. These terms are in addition to, and do not limit, any non-waivable rights I may
have under applicable Ontario consumer protection legislation, including any statutory cooling-off
period and cancellation rights that apply to personal development services agreements.
- Minimum commitment. All memberships require a minimum commitment of three (3) consecutive
months from the date of enrolment. I understand I am responsible for all three (3) monthly payments
regardless of how frequently I use the facility, and that my membership cannot be cancelled during
the minimum commitment period except as required by law.
- Valid credit card on file. A valid credit card is required on file at all times for the duration of my
membership. I authorize The Jayl House to charge that card automatically on my recurring billing
date for all membership fees and any applicable taxes. I am responsible for keeping my card
information current, including updating expiry dates and replacement cards. If a payment fails, my
membership may be suspended until payment is resolved, and suspension does not pause, extend, or end my minimum commitment.
- Continuation after the minimum term. Following the three (3) month minimum commitment, my
membership continues automatically on a month-to-month basis at the then-current rate until
cancelled in accordance with the notice requirements below.
- Cancellation. After the three (3) month minimum commitment is complete, I may cancel my
membership by emailing thejaylhouse@outlook.com. Our staff will respond as soon as possible to
confirm receipt. Fourteen (14) days’ written notice is required for all membership cancellations. My
cancellation takes effect fourteen (14) days from the date my written notice is received, and I remain
responsible for any scheduled payment that falls within that notice period. Verbal cancellation
requests are not accepted. Membership fees already paid are nonrefundable.
16. Severability & Governing Law
If any provision of this Waiver is found to be unenforceable or invalid, that provision will be severed
and the remaining provisions will continue in full force and effect. This Waiver is governed by and
interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada
applicable therein, and I agree that the courts of Ontario will have jurisdiction over any dispute
arising from it.
17. Acknowledgement & Agreement
By signing or electronically accepting below, I confirm that I have read this Waiver in its entirety,
that I understand its contents, that I have had the opportunity to ask questions, and that I agree to
be bound by its terms. I acknowledge that this is a legally binding document. I am signing this
Waiver freely and voluntarily, without any inducement or assurance of any nature, and I intend it to
be a complete and unconditional release of all liability to the greatest extent allowed by law.
